NOTICE TO USER: This Terms of Use Agreement is a complete and legal Agreement between You and Her Majesty the Queen in Right of Alberta as represented by the Minister of Education (the “Minister”) regarding the use of Guide to Career and Technology Studies (CTS) (this “Resource”). By using this Resource, You accept all the conditions of this Agreement. If You do not agree with the following terms and conditions, do NOT use this Resource and remove all associated files from your system.

 

In return for the right to use this Resource, You agree as follows:

 

1. Scope of Use

 

This Resource is licensed, not sold, to You by the Minister for use on single workstations and/or on a computer network in an Alberta school jurisdiction.

 

A “computer network” is any combination of two or more terminals electronically linked and capable of sharing the use of a single electronic resource.

 

To “use” the Resource is to load included files into either temporary (e.g., RAM) or permanent (e.g., hard disk, CD-ROM) memory of a computer.

 

2. Permitted Uses

 

You may

  • reproduce this Resource as is for unlimited, non-profit use within your school jurisdiction provided You include the accompanying Copyright notice, this Agreement, and all other proprietary notices contained in the original Resource

  • include portions of this Resource, as is or modified, in your own electronic or printed lesson materials. Only material owned by the Minister may be altered. Third-party content, which is acknowledged by a credit to the source, must be used as is in the context in which it has been placed. It may not be altered or repurposed for use in another resource without permission from the original rights holder.

3. Restrictions

 

You may not, without written permission from the Minister,

  • do anything with this Resource that is not expressly permitted in this Agreement
  • decompile, disassemble, reverse engineer, or otherwise attempt to derive its source code
  • remove or obscure copyright or trademark notices
  • sell, rent, lease, or sublicense this Resource without written permission from the Minister

It is illegal to reproduce, modify, translate, loan, distribute, sublicense, sell, rent, or lease this Resource in connection with a for-profit venture without written permission from the Minister.

4. Assignment

 

Rights granted under the terms of this Agreement are non-exclusive and non-transferable. This Agreement does not grant You any right (whether by licence, by ownership, or otherwise) in or to intellectual property with respect to this Resource.

 

5. Term

 

This Agreement is effective for as long as this course is an authorized Resource of the Minister. It may automatically terminate sooner, without notice to You, if You fail to comply with any of the terms. Upon termination of this Agreement, You must destroy all copies of the Resource and any related documentation.

 

6. Warranty

 

The Minister provides this Resource as is and specifically does not warrant that this Resource will operate uninterrupted or error free. The Minister makes no warranties—express or implied—arising from use of this Resource and the Minister expressly excludes any and all warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.

 

7. Limit of Liability and Hold Harmless

 

Under no circumstances will the Minister be Liable to You for any consequential or incidental damages arising from use of this Resource, including lost profits or lost savings, or for any claim by any party. You agree to hold harmless the Minister from any and all third-party claims, demands, or actions for which You are legally responsible, including those arising out of negligence or willful acts by You or by others under your control.

 

8. Governing Law

 

The laws of the Province of Alberta shall govern this Agreement.

 

9. Internet Disclaimer

 

External Internet sites listed in this Resource are provided as an added source of information on an as is basis and without warranty of any kind. Alberta Education is not responsible for the content on external sites nor do URL listings in this Resource constitute or imply an endorsement of the site’s content. The Crown, its agents, employees, or contractors will not be liable to You for any direct or indirect damages arising from the use of any of these sites.
